Hello everyone, I really need help with this assignment. I have so much homework to do and I can’t keep up. This is for a test so I need the answers written out very well.
Q1. Data Analytics, Inc., and eProducts Corporation market competing software products. Data Analytics launches an advertising campaign claiming that eProducts, instead of testing software before it is marketed, has customers “test” the software by using it. eProducts knows this is not true but begins to lose sales to Data Analytics. On what grounds could eProducts sue Data Analytics for injury to eProducts’ reputation?
Q2. Dixie, a driver for Express Delivery Company, leaves the truck’s motor running in neutral and carelessly forgets to set the parking brake while she makes a delivery. The truck rolls and crashes into a nearby gas station pump, igniting a fire that spreads quickly to a construction site a block away. A burned wall collapses onto a crane, which falls on Fazio, a bystander, and injures him. What must Fazio show to recover damages from Express Delivery?
Q3. Vogel bought a phone made by WiFi Communications, Inc. Three months later, after recharging the battery through a power jack, Vogel picked up the phone only to have it ignite in his hand. Suffering a severe burn, Vogel filed a suit against WiFi, alleging that a design defect in the phone weakened the connection between the power jack and the motherboard, causing the wiring to overheat and creating an unreasonable safety hazard. Could Vogel succeed on his strict product liability claim? Explain.
Q4. Precision Tool Corporation sells a product that is capable of seriously injuring consumers who misuse it in a foreseeable way, even though the label warns against the misuse. Does the firm have an ethical duty to take this product off the market? What conflicts might arise if the firm stops selling this product?
